SMS Terms & Conditions

1. Program Description

Capture and Motion LLC offers an SMS notification service that allows event photographers to send text messages to event guests with links to view and download their photos.

Program Name: khrome Photo Delivery SMS

Message Types:

• Gallery Delivery Notifications: SMS messages containing a secure link to view event photos
• Reminder Messages: Optional follow-up reminders about photo availability (if enabled by photographer)

Message Frequency:

• Typically 1-3 messages per event
• Initial notification when photos are ready
• Optional reminder if photos are not accessed within 7 days

Transactional Only: This is a transactional messaging service. We send messages solely to deliver access to event photos. We do NOT send marketing, advertising, or promotional content via SMS.

2. How You Get Subscribed

Consent Collection: Your phone number was collected by the event photographer at an event you attended (wedding, party, corporate event, etc.). By providing your phone number to the photographer and confirming opt-in, you consent to receive:

• Notification that your event photos are ready
• A secure link to view and download photos
• Optional reminder messages

Photographer Responsibility: The event photographer is responsible for obtaining your consent to receive SMS notifications and providing accurate phone numbers to khrome.

3. How to Opt-Out

You can opt-out of SMS messages at any time:

Option 1: Reply STOP

Reply STOP to any SMS message from khrome. You will immediately be unsubscribed.

Confirmation: You will receive one final message confirming your unsubscription.

Option 2: Reply UNSUBSCRIBE

Reply UNSUBSCRIBE to any message. This has the same effect as STOP.

Option 3: Contact Us

Email support@khro.me with your phone number and we will opt you out within 48 hours.

Effect of Opt-Out:

• You will not receive SMS messages from khrome for any future events
• This applies globally across all photographers using khrome
• You may still receive email notifications if the photographer has your email
• To access photos after opting out, ask the photographer for the gallery link directly

Re-Subscribing: Reply START or UNSTOP to re-subscribe. Alternatively, contact support@khro.me.

4. Help & Customer Support

Option 1: Reply HELP

Reply HELP to any SMS message from khrome to receive support information.

Option 2: Contact Support

Option 3: Contact the Photographer

For questions about a specific event or gallery, contact the photographer who sent you the message.

5. Carrier Compatibility

Supported Carriers: Our SMS service works with all major U.S. and Canadian carriers, including AT&T, Verizon, T-Mobile, Rogers, Bell, Telus, and regional carriers.

Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages. khrome uses Telnyx, a tier-1 SMS provider, but delivery cannot be guaranteed due to network congestion, carrier filtering, or phone settings.

Delivery Issues: If you do not receive an expected SMS:

1. Check your phone's spam folder
2. Ensure your phone has signal
3. Ask the photographer to resend
4. Email support@khro.me with your phone number

6. Message & Data Rates

Cost to You:

• Standard SMS messaging rates apply per your carrier plan
• Clicking the link uses mobile data (standard data rates apply)
• khrome does not charge recipients any fees

Data Usage:

• Loading gallery: ~500 KB - 2 MB
• Viewing photos: ~5-15 MB for 10 photos
• Downloading photos: ~2-10 MB per photo

We recommend using Wi-Fi when viewing/downloading photos.

7. Privacy & Data Protection

Information We Collect:

• Your phone number (provided by the photographer)
• Delivery status
• Opt-out/opt-in status
• Link clicks

How We Use Your Information:

• To deliver photo gallery links
• To honor opt-out requests
• To improve delivery success
• To comply with TCPA regulations

How We Share Your Information:

• With the photographer who sent you photos
• With Telnyx (our SMS provider) for delivery
• We do NOT sell your phone number
• We do NOT use your number for marketing

Data Retention:

• Phone numbers retained for 2 years from event date
• Opt-out numbers kept indefinitely to honor your request
• Request deletion anytime via privacy@khro.me

8. Compliance

TCPA Compliance: We comply with the Telephone Consumer Protection Act by:

• Sending only transactional messages (photo delivery)
• Honoring opt-out requests immediately
• Not sending messages between 9 PM - 8 AM local time
• Maintaining a Do Not Contact list

9. International Messages

Supported Regions:

• United States
• Canada

Some countries restrict transactional SMS. If outside the U.S./Canada, contact the photographer for alternative delivery (email).

10. Changes to These Terms

We may update these SMS Terms. Changes will be posted at khro.me/legal/sms.

Material Changes: We will send one SMS notification if terms change significantly.

Continued Consent: Receiving SMS messages after changes means you accept the updated terms.
